Agreement to Terms

By accessing or using Mapfolio ("Service", "Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Mapfolio provides a platform for exploring Swiss company data through interactive maps, search tools, and an API. We aggregate publicly available data from official Swiss commercial registries.

User Accounts

Account Creation

  • You must provide accurate, current information
  • You must be at least 16 years old
  • One person or entity may maintain only one account
  • You're responsible for maintaining account security
  • You must notify us immediately of any unauthorized access

Account Responsibilities

You are responsible for:

  • All activities under your account
  • Maintaining password confidentiality
  • Complying with these Terms
  • Any content you submit or share

Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse or misuse the Service
  • Fail to pay applicable fees

You may delete your account at any time from your account settings.

Acceptable Use

You May

  • Use the Service for lawful purposes
  • Search and view company information
  • Create and manage projects
  • Use the API according to your plan limits
  • Share public company data (with attribution)

You May Not

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access
  • Scrape or harvest data beyond API limits
  • Resell or redistribute our data without permission
  • Use the Service for spam or harassment
  • Impersonate others or provide false information
  • Interfere with Service operation
  • Reverse engineer our platform

Intellectual Property

Our Rights

Mapfolio owns all rights to:

  • The Service platform and software
  • Our trademarks, logos, and branding
  • The compilation and presentation of data
  • Original content and documentation

Your Rights

You retain rights to:

  • Content you create (notes, project descriptions)
  • Your account information

Company Data

Company data displayed on Mapfolio is publicly available information from official Swiss registries. We don't claim ownership of this public data.

License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service according to these Terms and your subscription plan.

Subscription Plans and Payments

Plans

  • Free Plan: Basic features with usage limits
  • Pro Plan: Enhanced features and higher limits
  • Enterprise Plan: Custom solutions and support

Billing

  • Subscriptions are billed monthly or annually
  • Prices are in Swiss Francs (CHF) or Euros (EUR)
  • All fees are exclusive of taxes
  • Payment is due upon subscription or renewal
  • We use Stripe for secure payment processing

Refunds

  • Monthly subscriptions: No refunds for partial months
  • Annual subscriptions: Pro-rated refunds within 30 days
  • No refunds for violations of Terms

Changes to Pricing

We may change prices with 30 days notice. Continued use after price changes constitutes acceptance.

API Usage

API Access

  • API access requires a paid subscription
  • Usage is subject to rate limits based on your plan
  • You must use your API key securely
  • Don't share your API key publicly

API Terms

  • Use the API only for permitted purposes
  • Don't exceed your rate limits
  • Cache responses appropriately
  • Attribute data to Mapfolio
  • Don't resell API access

API Changes

We may modify or discontinue API endpoints with reasonable notice.

Data Accuracy

Data Sources

We source data from official Swiss commercial registries. While we strive for accuracy:

  • Data is provided "as is"
  • We don't guarantee completeness or accuracy
  • Registry data may have delays or errors
  • We update data regularly but can't guarantee real-time accuracy

No Warranties

We make no warranties about:

  • Data accuracy or completeness
  • Service availability or uptime
  • Fitness for particular purposes

Privacy and Data Protection

Your privacy is important to us. See our Privacy Policy for details on how we collect, use, and protect your data.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • DATA ACCURACY

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We're not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to fees paid in the last 12 months
  • We're not liable for third-party actions or content
  • We're not liable for data loss (maintain your own backups)

Indemnification

You agree to indemnify and hold Mapfolio harmless from claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your content or actions

Changes to Terms

We may modify these Terms at any time. We'll notify you of significant changes via:

  • Email notification
  • Prominent notice on the Service
  • In-app notification

Continued use after changes constitutes acceptance.

Termination

By You

You may terminate your account at any time by:

We may terminate or suspend your account:

  • For violations of these Terms
  • For fraudulent or illegal activity
  • For non-payment
  • At our discretion with or without cause

Upon termination:

  • Your access to the Service ends immediately
  • We may delete your account data (subject to legal requirements)
  • Fees paid are non-refundable (except as stated above)
  • Provisions that should survive termination will remain in effect

Dispute Resolution

Governing Law

These Terms are governed by Swiss law, without regard to conflict of law principles.

Jurisdiction

Any disputes shall be resolved in the courts of Zürich, Switzerland.

Arbitration

For disputes under CHF 10,000, parties agree to binding arbitration in Zürich, Switzerland.

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Mapfolio.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver

Failure to enforce any right doesn't waive that right.

Assignment

You may not assign these Terms. We may assign our rights and obligations.

Force Majeure

We're not liable for delays or failures due to circumstances beyond our control.

Notices to you may be sent via email or posted on the Service.
